Are you exercising "Reasonable Care" as U.S. Customs Requires? While difficult to define, Customs knows it when they see it through the proactive steps you take to be informed. Here are few questions to guide you as you think about your current practices... ➡ As an importer, are you sure you have provided Customs with a complete and accurate description of your imported articles and that the subsequent classification is correct? ➡ Do you know what CBP’s requirements are for invoice descriptions and classifications? ➡ If you use a Customs broker, can you articulate why and how you chose that particular broker? ➡ Can you show Customs that you and your broker discuss CBP matters that affect your imports? ➡ How often do you communicate with your broker, whether by email, newsletter, or direct written or verbal communication? ➡ Have you discussed assists, royalties, records retention, how your imports are valued for Customs entry, country of origin, marking, buying and selling commissions, and related parties? Reasonable care is broadly defined (and applies to each and every aspect of your importing process), but it is crucial to Customs compliance. ✅ It is one of many reasons for importers to have a strong relationship with an experienced Customs broker.

Would your company know what to do if you received a CBP Form 28 or 29 from U.S. Customs? ▶ CF 28 is a Notice of Information When documentation for a particular entry does not provide sufficient information for valuation or classification, CBP uses this form to request additional information. ▶ CF 29 is a Notice of Action The notice of action has two primary uses – to propose or take an action on a particular entry. ✅ The short answer is to notify your Customs broker immediately. **CBP often does not send a courtesy copy of these forms to your broker, and it is crucial that you alert them as soon as possible. _________________ #compliance #Customsbroker

Binding rulings... ✅ provide uniformity across all ports of entry ✅ can be a means of exercising reasonable care ✅ protect the #importer from variations in interpretation from current and future CBP personnel A binding ruling enables importers to get merchandise classification decisions from CBP that are binding on all future shipments of the product. (Importers can also apply for binding rulings on other CBP issues such as marking, origin, NAFTA and applicability of Trade Programs.)
